Terms of Service

1. Acceptance

By setting up, owning, or being granted access to a heardhere station, you agree to these terms. If you don't agree, don't use the service.

2. The service

heardhere provides a solar and/or 4G-powered hardware unit that listens for bird and bat activity and, where fitted, monitors local weather, then publishes the results on a website hosted at a subdomain of heardhere.uk. We also provide an owner dashboard for managing your station, inviting team members, generating reports, and controlling public visibility.

3. Accounts

You're responsible for keeping your account credentials secure and for all activity under your account. Station owners can invite additional team members at editor or viewer level; owners are responsible for managing who has access to their station. A station can never be left without at least one owner.

By default, a station's page and its detection data are publicly visible at its subdomain. You can make a station private at any time from the owner dashboard, which restricts access to you and your invited team. Making a station private removes it from the public stations directory and the homepage's featured station.

6. Third-party integrations

You may optionally opt in to sharing your station's bird detections with BirdWeather (birdweather.com), a separate, independently-operated service. If you enable this, your data becomes subject to BirdWeather's own terms and privacy practices, which we don't control.

7. AI-generated content

Naturalist commentary and generated reports (including biodiversity/BNG-oriented reports) are produced using an AI model based on your station's real detection and weather data. While we design these features to avoid overstating confidence, AI-generated narrative content can contain errors and should not be treated as a substitute for a qualified ecological survey or professional assessment — particularly where a report may be used to support planning, funding, or compliance decisions. You're responsible for independently verifying any AI-generated content before relying on it for such purposes.

Report generation is subject to a monthly usage limit per station, shown in your dashboard, to keep the service sustainable.

8. Payment

Where you buy a station through our online configurator ("Own it"), hardware and subscription prices are shown to you before checkout and taken via Stripe, our payment processor — we do not receive or store your card details ourselves. The hardware price is a one-off charge taken at checkout, in advance of your unit being built to your chosen configuration and shipped. Your payment method is saved securely with Stripe at checkout for the subscription, but the subscription itself is not billed at that point — it begins only once your station is set up and live, and is billed in advance from that date and continues until cancelled.

You can view your current plan, update your payment method, change your connectivity plan, or cancel your subscription at any time from the Subscription & billing section of your owner dashboard, which opens Stripe's own secure billing portal. If your subscription lapses or a payment fails and isn't resolved, we may suspend station features (such as AI Naturalist commentary or managed connectivity) until payment is brought up to date; we'll try to notify you by email first.

"Rent it" and "Partner" pricing is agreed with us directly and isn't currently processed through this platform.

[Solicitor review still needed on two points specific to this section: (1) whether the 14-day right to cancel a distance/online contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 applies to the hardware purchase, given each unit is built to the customer's chosen configuration after ordering — goods "made to the consumer's specifications or clearly personalised" are a recognised exemption from that right, but whether our configurator's choices (sensor tier, connectivity, power, camera) meet that bar hasn't been confirmed; and (2) the subscription cancellation and refund mechanics (e.g. whether a part-used billing period is refunded pro-rata or not) against the Consumer Rights Act 2015.]

9. Hardware and service availability

heardhere stations are physical devices, often deployed outdoors and dependent on solar power, battery, and 4G or WiFi connectivity. We do our best to keep units online and monitor them for faults, but we can't guarantee uninterrupted operation — weather, connectivity, and hardware wear can all affect availability. We are not liable for gaps in detection data caused by factors outside our reasonable control.

10. Intellectual property

The heardhere platform, branding, and software remain our property. Detection data, recordings, and content generated from your station belong to you, though we retain the right to operate, store, and process it as necessary to provide the service.

11. Limitation of liability

To the extent permitted by law, heardhere is not liable for indirect, incidental, or consequential losses arising from use of the service, including loss of data, loss of detections during an outage, or reliance on AI-generated content. This includes losses caused by failure or malfunction of your station's hardware; bugs, errors, or downtime in our software or platform; and outages or failures of the third-party services we rely on to provide heardhere, including (without limitation) our payment processor (Stripe), infrastructure and hosting provider (Cloudflare), email relay for camera alerts (Mailgun), AI model providers used for naturalist commentary and camera image screening, weather data providers, and mobile/broadband connectivity carriers. We choose these providers carefully but don't control their uptime or performance, and a failure on their part is outside our reasonable control in the same way severe weather or a connectivity dropout is.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under English law. If you're using heardhere as a consumer rather than for the purposes of a trade, business, craft, or profession, nothing in these terms affects the statutory rights you have under the Consumer Rights Act 2015, and nothing here is intended to exclude or limit those rights.

12. Termination and decommissioning

You may stop using the service or request decommissioning of a station at any time by contacting us. We reserve the right to suspend or terminate accounts that breach these terms.

13. Governing law

These terms are governed by the laws of England and Wales, and the English and Welsh courts have non-exclusive jurisdiction over any dispute. If you're a consumer resident elsewhere in the UK or the EEA, this doesn't remove any mandatory protection your local law gives you, and you can still bring proceedings in your own country's courts. [Confirm England and Wales is the intended jurisdiction for the business as a whole before publishing — this is otherwise a standard consumer-safe formulation.]

14. Changes

We may update these terms from time to time; the "last updated" date above will reflect the latest version. Continued use of the service after a change constitutes acceptance of the updated terms.
